According to the Circular, the Management Council represents ministries, ministerial-level agencies, government agencies, organizations established by the Government or the Prime Minister that are not public non-business units, and provincial People's Committees within public non-business units.
The duties and powers of the Management Council are carried out according to Clause 3, Article 7 of Decree No. 120/2020/ND-CP: Deciding on the objectives, strategies, and medium-term and annual development plans of the public non-business unit; approving the organizational and operational regulations of the public non-business unit to submit to the competent authority for approval; making decisions on the policy of building the organizational structure, recruitment, training, development, reward, and discipline of officials and employees; finances, assets, investment in physical infrastructure, procurement of equipment, and mobilization of necessary resources for the development of the public non-business unit's activities...
The Circular specifies that the structure of the Management Council includes: Representatives of the higher management agency of the public non-business unit, including representatives of ministries, ministerial-level agencies, government agencies, organizations established by the Government or the Prime Minister that are not public non-business units, provincial People's Committees, and the direct higher management agency (if any); working concurrently; the head of the public non-business unit; officials of the public non-business unit; and representatives of related organizations and units.
The number of members of the Management Council ranges from 5 to 11 people, including the Chairman of the Management Council, the Secretary of the Management Council, and the Members of the Management Council. Depending on the task requirements, the Management Council may have a Vice Chairman of the Management Council. The number and structure of the Management Council members for each specific public non-business unit are determined by the head of the competent authority approving the autonomy plan of the public non-business unit.
The term of the Management Council members is not more than 5 years.
Regulations on the Activities of the Management Council
The regulations on the activities of the Management Council include the following key contents: General provisions; functions, duties, and powers of the Management Council; number, structure, and term of the Management Council members; operating mechanism of the Management Council; duties and powers of the Management Council members; appointment, supplementation, replacement, dismissal, and discipline of Management Council members; working relationships; and other regulations ensuring the activities of the Management Council according to the law.
The Management Council operates collectively and makes decisions by majority vote. The decisions of the Management Council are issued in the form of Resolutions. A Resolution of the Management Council is approved when at least three-quarters of the members attending the meeting agree, through a secret ballot. The specific voting method is specified in the Regulations on the activities of the Management Council.
The Management Council meets periodically according to its Regulations; extraordinary meetings are held as needed or upon the request of the Chairman of the Management Council, the head of the public non-business unit, or a written request from the majority of the Management Council members.
This Circular takes effect from September 9, 2024.
