From July 15, 2022, employees are allowed to temporarily stay, stay in accommodation establishments in industrial parks to serve production and business activities of enterprises, according to the provisions of Decree 35/2022/ Decree-CP of the Government.
From July 15, 2022, the Government's Decree 35/2022/ND-CP on management of industrial parks (IZs) and economic zones takes effect, which stipulates that employees are allowed to temporarily stay, staying at accommodation establishments in the industrial zone to serve production and business activities of enterprises.
According to Article 25 of this decree, there is no permanent place of residence in the IZ as prescribed by the law on residence. Experts and employees are allowed to temporarily stay and stay at accommodation establishments in the industrial zone to serve production and business activities of enterprises, which must comply with the law.
Accordingly, experts and employees are Vietnamese and temporarily reside in industrial zones in accordance with the law on residence. Foreign experts and employees make temporary residence in accordance with the law on entry, exit, transit and residence of foreigners in Vietnam.
Accommodation facilities are built in the service land area of the industrial zone; ensure a safe distance from the environment according to the provisions of the law on construction and other relevant provisions of law; ensure security and order and do not affect production and business activities of enterprises in the IZ.
In case of force majeure due to the direct impact of natural disasters, environmental disasters, fires, epidemics, wars, demonstrations, riots or other emergencies, Vietnamese experts and employees are entitled to permit to stay at the enterprise in the IZ in accordance with the law on residence.
For experts, foreign employees are allowed to stay in the enterprise in the IZ for less than 30 days and must make a declaration of temporary residence in accordance with the law on entry, exit, transit. residence of foreigners in Vietnam.
Currently, Article 29 of Decree 82/2018/ND-CP of the Government stipulates that residents are not allowed to live in industrial parks and export processing zones.
In case of necessity, managers, executives, and experts who are foreigners are allowed to temporarily reside in enterprises in industrial zones or export processing zones according to regulations of the provincial People's Committee. The temporary residence of foreigners must satisfy the conditions in Clause 3, Article 29 of Decree 82/2018/ND-CP.
